Critical Notice

Ride Rescue is ONLY a directory platform. We are NOT a transportation company. We do NOT employ, hire, manage, or control any drivers. All drivers listed in our directory are independent contractors operating their own businesses. By using this platform, you acknowledge and agree to these terms.

1. Platform Description and Scope

1.1 Directory Platform Only: Ride Rescue operates exclusively as an online marketplace directory platform that connects riders with independent drivers. We provide a listing service where independent drivers can advertise their transportation services and riders can search for and contact these independent drivers.

1.2 No Transportation Services: Ride Rescue does NOT provide, offer, or facilitate any transportation services whatsoever. We do not own, operate, or control any vehicles. We do not employ, hire, supervise, manage, or direct any drivers.

1.3 Independent Contractors: All drivers listed in our directory are independent contractors who operate their own independent transportation businesses. They are NOT employees, agents, or representatives of Ride Rescue.

1.4 Direct Relationships: Any and all agreements, arrangements, payments, and relationships are formed directly between riders and independent drivers. Ride Rescue is not a party to these relationships.

2. User Responsibilities and Assumption of Risk

2.1 Rider Assumption of Risk: By using our directory to find and contact independent drivers, riders explicitly acknowledge and assume ALL risks associated with transportation services, including but not limited to:

  • Personal injury or death
  • Property damage or loss
  • Vehicle accidents or incidents
  • Driver conduct or behavior
  • Service quality or reliability
  • Pricing disputes
  • Schedule changes or cancellations

2.2 Independent Verification: Riders are solely responsible for verifying the credentials, insurance, licensing, and suitability of any independent driver they choose to contact or hire through our directory.

2.3 Direct Arrangements: All arrangements, including pricing, scheduling, payment terms, pickup locations, and service details, are made directly between riders and independent drivers. Ride Rescue has no involvement in or control over these arrangements.

3. Independent Driver Status and Obligations

3.1 Independent Contractor Status: Drivers listed in our directory are independent contractors who:

  • Operate their own independent transportation businesses
  • Set their own rates, schedules, and service areas
  • Maintain their own vehicles and insurance
  • Are responsible for all taxes, licenses, and permits
  • Make their own business decisions
  • Are NOT employees or agents of Ride Rescue

3.2 No Employment Relationship: Nothing in these Terms or the use of our directory platform creates an employment, agency, partnership, or joint venture relationship between Ride Rescue and any driver.

3.3 Driver Obligations: Independent drivers are solely responsible for:

  • Maintaining valid licenses and permits
  • Carrying adequate insurance coverage
  • Vehicle maintenance and safety
  • Compliance with all applicable laws and regulations
  • Their conduct and behavior
  • Service quality and customer satisfaction
  • Payment processing and tax obligations

4. Limitation of Liability

4.1 Maximum Liability Limit: TO THE FULLEST EXTENT PERMITTED BY LAW, RIDE RESCUE'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE USE OF OUR DIRECTORY PLATFORM SHALL NOT EXCEED THE AMOUNT OF DIRECTORY LISTING FEES PAID BY THE DRIVER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

4.2 No Liability for Transportation Services: Ride Rescue shall have NO LIABILITY whatsoever for any claims, damages, injuries, losses, or disputes arising from or related to:

  • Transportation services provided by independent drivers
  • Actions, omissions, or conduct of independent drivers
  • Vehicle accidents, incidents, or malfunctions
  • Personal injury, death, or property damage
  • Service quality, reliability, or availability
  • Pricing disputes or payment issues
  • Cancellations, delays, or schedule changes
  • Lost or damaged property
  • Criminal acts or intentional misconduct

4.3 Disclaimer of Warranties: THE DIRECTORY PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

4.4 No Consequential Damages: IN NO EVENT SHALL RIDE RESCUE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

5. No Guarantee of Driver Performance

5.1 No Performance Guarantees: Ride Rescue makes NO guarantees, warranties, or representations regarding:

  • The quality, safety, or reliability of independent drivers
  • The accuracy of driver profiles or information
  • Driver availability or responsiveness
  • Service completion or satisfaction
  • Pricing or payment terms
  • Vehicle condition or cleanliness
  • Driver conduct or professionalism
  • Compliance with laws or regulations

5.2 Verification Limitations: While we may conduct basic verification of driver credentials, such verification:

  • Does NOT constitute an endorsement or guarantee
  • Does NOT ensure driver competence or safety
  • Does NOT create any liability for Ride Rescue
  • May not be current or complete
  • Should not be relied upon as the sole basis for hiring a driver

5.3 User Reviews: Reviews and ratings displayed on our platform are provided by users and do not represent the views or opinions of Ride Rescue. We do not verify the accuracy of reviews and are not responsible for their content.

6. Dispute Resolution

6.1 Direct Resolution: Any disputes arising from transportation services must be resolved directly between the rider and the independent driver. Ride Rescue is not a party to such disputes and has no obligation to mediate, arbitrate, or resolve them.

6.2 Binding Arbitration: Any disputes between users and Ride Rescue arising from the use of our directory platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

6.3 Class Action Waiver: Users agree to resolve disputes with Ride Rescue on an individual basis only and waive any right to participate in class action lawsuits or class-wide arbitration.

6.4 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

6.5 Venue: Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in [Your County, State].

7. Indemnification

  • Interactions with independent drivers or riders
  • Any content or information posted on the platform
  • Violation of any laws or regulations
  • Infringement of third-party rights

7.2 Driver Indemnification: Independent drivers additionally agree to indemnify Ride Rescue for any claims arising from their transportation services, vehicle operation, or business activities.

8. Additional Terms

8.1 Modifications: Ride Rescue reserves the right to modify these Terms at any time. Continued use of the platform after modifications constitutes acceptance of the updated Terms.

8.2 Termination: We may suspend or terminate access to our directory platform at any time, for any reason, without notice or liability.

8.3 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

8.4 Entire Agreement: These Terms constitute the entire agreement between users and Ride Rescue regarding the use of our directory platform.

8.5 No Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
